Client Agreement & Terms
Welcome to DUNA Wellness. We believe wellness should feel simple, intentional, and enjoyable. These Client Agreement & Terms establish the basic terms that apply to your use of DUNA Wellness, including memberships, classes, ballet programs, spa and wellness services, appointments, and purchases.
By creating an account, purchasing a membership, booking a class or service, or participating at DUNA Wellness, you agree to these terms.
1. Your Account & Services
You agree to provide accurate information when creating an account or booking services.
Your account and any membership or service purchased are personal to you and may not be transferred or shared unless DUNA expressly allows it.
Services, schedules, instructors, availability, pricing, and offerings may change from time to time. DUNA will make reasonable efforts to communicate material changes.
2. Payments & Refunds
You agree to pay the price shown at the time of purchase or booking.
Recurring memberships will automatically renew according to the terms presented when you enroll, unless properly cancelled.
You are responsible for keeping your payment information current. Failed payments may result in suspension of services or membership benefits until the balance is resolved.
Memberships provide access to the services and benefits specifically included in the membership purchased. Memberships do not guarantee availability of a particular class, instructor, appointment, or time.
Members may pause their membership for up to two (2) months during any twelve-month period.
When a membership is cancelled, it remains active through the end of the current paid billing period. No prorated refunds or credits will be provided for unused days, classes, or membership benefits.
Payments for individual classes, packages, and appointments are also non-refundable unless required by law or otherwise approved by DUNA.
3. Cancelations & No-Shows
DUNA may establish reasonable cancellation windows for classes and appointments. Any applicable late-cancellation or no-show fees will be communicated when booking.
Membership cancellation is subject to the terms of the membership purchased and applicable Florida law.
For memberships subject to Florida health-studio laws, DUNA will provide all cancellation rights required by law, including any applicable statutory cancellation period.
Nothing in this Agreement limits any cancellation, refund, or other consumer right that cannot legally be waived.
4. Spa & Wellness Services
Please arrive on time for appointments. Late arrival may shorten the service while the full scheduled appointment time remains reserved for you.
Certain services may require information regarding allergies, medications, injuries, pregnancy, or other relevant conditions. You are responsible for providing accurate information that may affect the safety or suitability of a service.
DUNA may decline or modify a service when reasonably necessary for your safety or the safety of our practitioners.
DUNA Wellness provides wellness and personal-care services and does not provide medical diagnosis or treatment unless specifically provided by a properly licensed healthcare professional.
5. Physical Activity & Assumption of Risk
Some DUNA services involve physical activity, including Pilates, yoga, barre, ballet, fitness, stretching, and other movement-based activities.
You understand that physical activity carries inherent risks, including the possibility of injury.
You voluntarily participate and are responsible for determining whether an activity is appropriate for you. If you have a medical condition, injury, limitation, or other concern, you should consult an appropriate healthcare professional before participating.
You agree to follow reasonable instructions from DUNA instructors, practitioners, and staff.
6. Children & Teens
A parent or legal guardian must authorize participation in DUNA programs for anyone under 18.
The parent or guardian is responsible for providing accurate information and complying with applicable enrollment, payment, attendance, and cancellation requirements.
DUNA may establish reasonable safety and participation requirements for children's and teen programs.
7. Studio Conduct
DUNA is designed to be a calm, respectful, and welcoming environment.
You agree to treat our team and other guests respectfully, follow reasonable studio rules and safety instructions, and take reasonable care of DUNA property and equipment.
Harassment, threatening behavior, violence, sexual misconduct, discrimination, or intentional damage to property will not be tolerated and may result in suspension or termination of access to DUNA.
8. Personal Belongings
You are responsible for your personal belongings while at DUNA.
DUNA is not responsible for lost, stolen, or damaged personal property except where liability cannot legally be excluded.
9. Photos & Recording
DUNA may occasionally photograph or record activities within the studio for operational, educational, or promotional purposes.
Where required by law, DUNA will obtain appropriate consent before using an identifiable person for promotional purposes.
Guests may not photograph or record other guests without their permission.
10. Liability
To the fullest extent permitted by law, DUNA Wellness and its owners, employees, instructors, practitioners, contractors, and agents are not responsible for injuries, losses, or damages arising from your voluntary participation in DUNA activities, except where caused by conduct for which liability cannot legally be excluded.
DUNA may require a separate waiver or consent for certain activities when appropriate.
11. Changes & Termination
DUNA may reasonably modify its services, schedules, policies, or facilities.
DUNA may suspend or terminate access when necessary for safety, nonpayment, misconduct, or other legitimate business reasons, subject to applicable law and the terms of any active membership agreement.
12. General Terms
This Agreement is governed by the laws of the State of Florida.
If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in effect.
This Agreement applies to your use of DUNA Wellness and supplements any specific terms presented to you when purchasing a particular membership, class, program, or service. If a specific written membership agreement provides different terms required by law, those specific terms will control.
DUNA may update this Agreement from time to time. The current version will be made available to clients.
14. Agreement
By creating a DUNA Wellness account, purchasing a service or membership, or booking or participating in any DUNA Wellness service, you acknowledge that you have had the opportunity to review these Client Agreement & Terms and agree to be bound by them.
For minors, the parent or legal guardian accepts these terms on behalf of the participant.
